0) Dave Portnoy obstructs public sidewalk in order to (we infer) create a video advertisement of him PRETENDING to peddle his pizza to friendly actors PRETENDING to be passerby – we observe that he did not offer a slice of pizza to anyone in the following sequence of events.
1) PASSERBY using the public sidewalk encounters PORTNOY obstructing his use of the public sidewalk and experiences negative emotion in response to PORTNOY interfering with freedom of movement so that PORTNOY can grub money from PASSERBY’s peer college students
2) PASSERBY exercises his free speech by donating a small amount of money to observant Jew PORTNOY (whose pizza products are almost certainly contaminated by pork byproducts) while reciting a short chant that is common among American college students
Now here’s where it gets interesting.
3) Obese man in blue has been prepositioned to obstruct the sidewalk. He interferes with PASSERBY’s free use of a public sidewalk, interferes with PASSERBY’s freedom of association, and interferes with PASSERBY’s free speech by obstructing and threatening PASSERBY.
4) PASSERBY, feeling threatened by OBESEMAN, retreats and continues on his way, maneuvering around the obstructed public sidewalk by walking in the street, thereby exposing himself to the danger of being struck by a vehicle – by obstructing the public sidewalk, PORTNOY is forcing everyone to risk their life so that he can sell pizza.
5) PORTNOY establishes eye contact with PASSERBY and invites him to approach by raising his hand and moving his fingers in a summoning motion.
Unbeknownst to PASSERBY, this is a trap; it is a trick to get PASSERBY to come closer and to show his face to the camera in full light with no obstructions so that PASSERBY can be identified and retaliated against.
PORTNOY has no intention of discussing the legitimacy of his obstructing the sidewalk with PASSERBY. His intention is exclusively predatory. Based on information and belief, PORTNOY and his associates have used this script hundreds of times before, and this will be proven by an examination of court records.
6) PASSERBY mistakenly attempts to accept PORTNOY’s fake invitation but OBESEMAN again obstructs him from accepting PORTNOY’s fake invitation. PASSERBY continues on his way.
The two intercepts are premeditated because the act of repetition will be used by PORTNOY to show threat. The fact that PORTNOY did not feel threatened and in fact invited PASSERBY to approach will be concealed from the court. Therein lies the heart of the script.
PORTNOY (we infer) then pretends that he is a victim, on camera, and asserts that PASSERBY somehow lacked courage to confront him when nothing could be further from the truth and, in fact, the exact opposite is true – PORTNOY lacked courage, not PASSERBY, who acted upon his conviction that what PORTNOY was doing was not in the public interest.
The inversion of reality is noteworthy. We think that one of these two people – either PASSERBY or PORTNOY – is disconnected from external reality and is, technically speaking, insane. We need to address the problem of mentally ill people because mental illness is communicable. That’s why they call it a disease. Diseased people are a threat to the community.
Here’s what happens next.
7) PORTNOY will identify PASSERBY – I think that’s already happened.
8) PORTNOY will request a “temporary” restraining order against PASSERBY, claiming that he feels “threatened” and that he, all of his businesses and all of his business associates need to be protected by the armed might of every police agency in the United States from this boy’s two cents.
9) The restraining order, if granted, will be used to engage in lawfare against PASSERBY; in every disagreement he has, somehow the other party will know that PASSERBY has a pre-existing restraining order; soon, there will be two, then three. PASSERBY will experience unemployment and homelessness. We think he has already been forced to drop out of classes, this semester.
10) PORTNOY and his associates will use the count of restraining orders they have manufactured against the local population as evidence in future requests for restraint, demands for protection, complaints against police, disputes over permits, disputes over zoning, changes in local statutes, and political elections.
The only solution that appears to work against such a group of people who refuse to get along with their neighbors, take offense at everything, and turn everything into a conflict is to drive them out of your community, root and branch and ask them to find someplace else to live.
